Important: By using MediFusion AI, you agree to these Terms. If you do not agree, please do not use our services. These terms contain important provisions about liability limitations and dispute resolution.
1. Acceptance of Terms
By accessing or using MediFusion AI's platform, APIs, or services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.
2. Description of Services
MediFusion AI provides:
- Autonomous AI agents for healthcare operations
- Electronic health record management
- AI-assisted diagnostics and decision support
- Pharmacy and inventory management
- Insurance claims processing
- APIs and SDKs for integration
3. Account Registration
- You must provide accurate, complete registration information
- You are responsible for maintaining account security
- You must notify us immediately of unauthorized access
- One person or entity may not maintain multiple free accounts
4. Healthcare Compliance
AI Disclaimer: MediFusion AI provides decision support tools. Our AI does not replace professional medical judgment. All clinical decisions must be made by qualified healthcare professionals. Users are responsible for validating AI outputs before clinical use.
- Users must comply with all applicable healthcare laws (HIPAA, GDPR, local regulations)
- Business Associate Agreements (BAA) available for HIPAA-covered entities
- Users are responsible for obtaining necessary patient consents
- Data must be used only for authorized healthcare purposes
5. Acceptable Use
You agree NOT to:
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Services
- Transmit malware or harmful code
- Reverse engineer or copy our technology
- Use the Services to build competing products
- Share API keys or credentials
6. Intellectual Property
- Our IP: MediFusion AI owns all rights to the platform, AI models, and technology
- Your Data: You retain ownership of data you upload
- License: You grant us license to process your data to provide Services
- Feedback: Suggestions you provide may be used without compensation
7. Payment Terms
- Fees are as stated on our pricing page or your order
- Subscriptions renew automatically unless cancelled
- Prices may change with 30 days notice
- No refunds for partial months of service
- Overdue accounts may be suspended
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDIFUSION AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Indemnification
You agree to indemnify and hold harmless MediFusion AI from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.
11. Termination
- Either party may terminate with 30 days written notice
- We may suspend immediately for Terms violations
- Upon termination, your right to use Services ceases
- Data export available for 30 days after termination
12. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be notified via email or platform notice. Continued use after changes constitutes acceptance.
